WHY DO WE NEED YOUR EXPLICIT CONSENT TO USE THEM?
Judgment of the Grand Chamber of the Court of Justice of the European Union, October 1, 2019, and Guide on the use of cookies by the Spanish Data Protection Agency (AEPD), July 2020.
The judgment of the Grand Chamber of the Court of Justice of the European Union, dated October 1, 2019, must be interpreted as meaning that consent is not validly given when the storage of information, or access to information already stored on the user's terminal equipment, through cookies is authorized by a checkbox marked by default, which the user must uncheck if they wish to reject their use. The Grand Chamber of the Court of Justice of the European Union also stipulates in this ruling that the information that the service provider must provide to the user of a website must include the duration for which cookies will remain active and the possibility that third parties may access the information they store. This requirement is established in the version amended by Directive 2009/136, which modifies Article 5(3) of Directive 2002/58/EU, and by the AEPD Guide of July 2020.
